McKinney, Texas — A federal judge in El Paso has granted a preliminary injunction temporarily halting border barrier construction across the Big Bend region of West Texas, siding with conservation advocates and local property owners who challenged the federal initiative.

The decision pauses activity across five contracted barrier projects in West Texas, where regional allocations exceed $7.5 billion within a wider $46 billion federal border security undertaking. Attorneys from the Center for Biological Diversity filed the litigation representing Presidio County river outfitter Danny William Miller, whose acreage lies directly along the barrier path, and the Friends of the Ruidosa Church, an organization focused on protecting a historic landmark church in Presidio County. The legal complaint contends federal officials unlawfully bypassed environmental safeguards, including the Endangered Species Act and the National Environmental Policy Act, through administrative waivers.

In her bench ruling, U.S. District Judge Kathleen Cardone concluded that the challengers demonstrated a likelihood of success on their legal claims and faced substantial, irreversible injury without court intervention. U.S. Customs and Border Protection defended the undertaking, asserting confidence in federal border security prerogatives while safeguarding West Texas terrain, and noted ongoing coordination with Justice Department attorneys.

The judicial order encompasses Big Bend National Park alongside upstream and downstream tracts along the Rio Grande where contractors had begun bulldozing access routes across public and private parcels. Landowners, local businesses, and environmental organizations across the region raised bipartisan objections to the construction, arguing that the 500-mile remote desert corridor naturally impedes illicit travel and that physical barriers cause irreparable damage to fragile wilderness.
